How long do I have to take action against a dismissal?
From the date you receive the dismissal notice, you have exactly 3 weeks to file a dismissal protection claim with the Labour Court. This deadline is strict, and once it expires, you can no longer challenge the dismissal.
When am I entitled to severance pay?
A legal entitlement to severance pay exists only in exceptional cases. In practice, severance payments are often agreed as part of a settlement or a termination agreement. A common rule of thumb is: 0.5 gross monthly salaries per year of employment.
Can I get sick during the notice period?
Yes, getting sick during the notice period is generally allowed and legally valid. The notice period does not get extended as a result. You are still entitled to continued salary payment during illness according to statutory regulations.
What is the difference between ordinary and extraordinary dismissal?
An ordinary dismissal is issued with notice periods being observed (e.g., 4 weeks to the 15th or the end of the month). An extraordinary (summary) dismissal ends the employment relationship immediately and is only permitted for serious reasons that make continued employment unreasonable.
Do I have to sign a termination agreement?
No, you are not required to sign a termination agreement. Do not let anyone pressure you. A termination agreement may lead to a waiting period for unemployment benefits. We strongly recommend seeking legal advice before signing.
Who pays the legal fees in a dismissal protection lawsuit?
In labour court proceedings, each party pays their own legal fees in the first instance, regardless of the outcome. If you have legal expenses insurance, the costs are usually covered. Legal aid may be available depending on your income.
How long does a dismissal protection lawsuit take?
In the first instance, a dismissal protection case typically takes around 2-6 months until the initial conciliation hearing. Many cases are settled at this stage. If the case proceeds to a contested hearing, it may take 6-12 months.
