How much does a divorce in Germany cost?
The cost of an uncontested divorce typically ranges between €1,500 and €3,000 (including lawyer and court fees). In contested divorces, costs can be significantly higher. The exact amount depends on the value of the proceedings (income and assets).
How long does an uncontested divorce take?
An uncontested divorce usually takes around 4-6 months from filing the divorce petition. A one-year separation period is required. In hardship cases, or if both spouses agree and have been separated for at least 3 years, it may be faster.
Who gets the house in a divorce?
That depends on the ownership situation. If the house is jointly owned, it can be sold, transferred to one spouse, or a usage arrangement can be agreed upon. The equalization of accrued gains and potential maintenance claims also play a role. Individual legal advice is essential here.
What is the equalization of accrued gains (Zugewinnausgleich)?
The Zugewinnausgleich is the equalization of assets acquired during the marriage. Each spouse keeps their initial assets (at the time of marriage). The increase in assets during the marriage is divided equally. The spouse who gained more must pay half of the difference to the other.
Can child custody be changed?
Yes, custody can be changed upon application to the Family Court if it is in the best interests of the child. A substantial change in circumstances is required. The court always decides based on the child’s welfare and may also hear the child once they reach a certain age.
How is child support calculated?
Child support is based on the Düsseldorf Table and the paying parent’s adjusted net income, as well as the child’s age. Child benefit is credited by half. For 2026, minimum child support is €480 (ages 0-5), €551 (ages 6-11), and €645 (ages 12-17).
Do I need a lawyer for a divorce?
Yes, divorce proceedings in Germany require legal representation, at least for the applicant. In an uncontested divorce, one spouse can instruct the lawyer while the other simply agrees. This significantly reduces costs compared to hiring two separate lawyers.
